On April 13, 2016 the Office of Administrative Hearings issued a final decision on an appeal which explains that the terms of our Health Plan do not permit Aetna to assess any deductible under our Plan in addition to the separate deductible assessed by Medicare.  If Aetna assessed a separate deductible on your claims in 2015 or in 2016 after Medicare assessed its deductible, you may appeal that assessment under this decision.  DRB made an amendment to the Health Plan in May 2016 that modifies the terms of the Plan, which would allow Aetna to deduct a separate deductible under our Plan in addition to the deductible assessed by Medicare, but it is not clear this amendment is lawful under Alaska law.
